Mel Tucker to Appeal Sexual Harassment Ruling from Michigan State as Wrongful Termination Suit Looms
Tucker has been in a litigation battle with the university since his firing in September, and continues to deny wrongdoing
Former Michigan State head coach Mel Tucker will appeal the university's sexual harassment ruling against him, according to his agent.
Tucker was fired for cause for allegedly sexually harassing Brenda Tracy, who he claimed to have a personal relationship with before saying Tracy had motives to get him fired.
"The decision is fraught with countless factual and legal errors, all of which will be the subject of an immediate appeal and subsequent lawsuit if necessary," Tucker's representation said in a Thursday statement. "The appeal will include evidence recently discovered and previously suppressed by Ms. Tracy."
Tucker's camp described Wednesday's ruling as biased, and takes issue with Tracy asking for a suppression of prior statements despite supplying USA Today with a 70-page report.
The Law Firm of Foley and Lardner released a 106-page letter of new evidence regarding the case on Oct. 5, and the appeal is expected to highlight evidence from the letter, along with Tracy's suppressed statements. Tucker also informed the university he intends to file a wrongful termination suit.
The Spartans are 2-5 this season, ranking last in the Big Ten East.
