Fulton County Superior Court Judge Scott McAfee is considering arguments Tuesday on filings by by pro-Trump attorneys Sidney Powell and Kenneth Chesebro to dismiss charges in the Georgia election-racketeering case ahead of their trial late this month
The Fulton County judge overseeing the sweeping 2020 Georgia election racketeering case is presiding Tuesday over arguments regarding motions by two former election attorneys for former President Donald Trump seeking to dismiss the charges against them.
Kenneth Chesebro’s legal team is seeking to dismiss the racketeering charges Willis obtained by citing protections under the Supremacy Clause and the First Amendment of the U.S. Constitution. Sidney Powell's attorneys have signed on in support of the arguments.
Powell and Chesebro, who have both pleaded not guilty, have invoked their right to a speedy trial under Georgia law, and their cases were severed from the other co-defendants in the case. They are scheduled to stand trial in less than two weeks, with jury selection starting Oct. 20.
The hearing was scheduled to begin at 1:30 p.m. EST and is being livestreamed on McAfee's YouTube channel.
