Donald Trump is now under a second gag order restricting certain things he can say in public about his pending criminal case for allegedly trying to overturn the 2020 presidential election results he lost.

In a three-page opinion and order issued Tuesday, U.S. District Court Judge Tanya Chutkan prohibited public statements that target prosecutors or their staff, defense lawyers or their staff, court staff and supporting personnel, and "any reasonably foreseeable witnesses or the substance of their testimony."

The order applies to all parties to the case, not just Trump.

Chutkan noted that her order does not prohibit Trump from making statements maintaining his innocence, describing his prosecution as politically motivated, "criticizing the government generally, including the current administration or the Department of Justice," or criticizing the campaign platforms of rivals in the 2024 presidential race, including former Vice President Mike Pence.

In her ruling, Chutkan noted Trump's public statements that particular individuals involved in his prosecution "are liars, 'thugs,' or deserve death" and said she found arguments by Trump's attorneys that his speech should not be limited during a presidential campaign to be "untenable."

"The bottom line is that equal justice under law requires the equal treatment of criminal defendants," Chutkan wrote. "Defendant’s presidential candidacy cannot excuse statements that would otherwise intolerably jeopardize these proceedings."

The opinion formalizes a ruling that Chutkan described from the bench Monday following a contentious two-hour hearing.

Any violations come with the prospect of sanctions should the former president and 2024 GOP front-runner cross the judge's line, Chutkan said at Monday's hearing.
