Prosecutor in Hunter Biden Probe Defends Investigation Against GOP Accusations, Denies Retaliation Against IRS Agent
David Weiss said he's willing to discuss the case with the Judiciary Committee at a more 'appropriate time'
U.S. Attorney David Weiss denied retaliating against an IRS agent and not having full control over his Hunter Biden investigation in a letter to House Judiciary Committee Chairman Jim Jordan.
In his Friday letter, Weiss responded to a request for materials from Jordan, who is one of many Republicans to blast the Department of Justice investigation into Hunter Biden's finances ending with a deal to plead guilty to tax evasion and a minor gun charge.
"The whistleblowers’ allegations relate to a criminal investigation that is now being prosecuted in the United States District Court for the District of Delaware. At this juncture, I am required to protect confidential law enforcement information and deliberative communications related to the case. Thus, I will not provide specific information related to the Hunter Biden investigation at this time," the attorney wrote.
Weiss said he had "ultimate authority" in his investigation to bring any charges he saw fit against Biden in any jurisdiction.
Weiss also denied retaliating against Gary Shapley, an IRS agent who accused the prosecutor of blocking a promotion after he agreed to speak to congressional Republicans about the Hunter Biden probe.
Shapley and another IRS agent have given testimony to congressional Republicans, alleging corruption on the part of Hunter Biden and accusing Weiss of slow-walking the investigation and not having authority over the charges he could present.

"The Department of Justice did not retaliate against an Internal Revenue Service Criminal Supervisory Special Agent and whistleblower, as well as his entire investigative team… for making protected disclosures to Congress," Weiss wrote.
The prosecutor did say he was willing to sit for interviews with congressional Republicans to discuss the accusations made by Shapley, but cannot do so while the investigation is not closed (Biden still needs to officially enter a plea).
"At the appropriate time, I welcome the opportunity to discuss these topics with the Committee in more detail, and answer questions related to the whistleblowers' allegations consistent with the law and Department policy," he wrote. "It is my understanding that the Office of Legislative Affairs will work with the Committee to discuss appropriate timeline and scope."
