24 Attorneys General Have Signed on to Back Biden Challenge to Idaho Abortion Laws

The group alleges Idaho's ban violates The Emergency Medical Treatment and Labor Act

24 state attorneys general have signed onto an amicus brief supporting President Joe Biden's administration's challenge to Idaho's abortion ban.

The group of Democratic attorneys general is led by New York Attorney General Letitia James and California Attorney General Rob Bonta.

Michigan Attorney General Dana Nessel was the latest to join the group, which alleges that the state of Idaho's ban violates the Emergency Medical Treatment and Labor Act. The federal law permits pregnancy-related emergency medical care.

“This federal legislation has long been interpreted to cover emergency medical conditions involving or affecting pregnancy for which necessary stabilizing treatment may include abortion," Nessel said in a statement. "I stand with my colleagues in supporting the Biden administration’s assertion that Idaho’s abortion ban must yield when pregnant women are in need of emergency abortion services.”

Idaho implemented the ban after the overturn of Roe v. Wade in June 2022. The state's law is one of the strictest abortion bans in the country and prohibits abortion at all stages of pregnancy.
